Notakto is a free, browser-based game you can play for fun. These terms keep things simple and set out what you can expect (and what you can't) when you use the site.
By accessing or using this site (the "Site") and the Notakto game (the "Game"), you agree to these Terms of Use. If you don't agree with them, please don't use the Site.
The Game
Notakto is a free implementation of multi-board Notakto, the X-only misère tic-tac-toe devised by Bob Koca in 2010, in which two players place X marks across two or three boards and whoever completes the three-in-a-row on the last live board loses. The Game is provided for entertainment and educational interest. No account, sign-up, or payment is required to play.
Provided "as is"
The Site and the Game are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. I don't guarantee that the Site will be uninterrupted, error-free, secure, or free of bugs, or that any defects will be corrected. Your use of the Site is at your own risk.
Limitation of liability
To the fullest extent permitted by law, the operator of this Site will not be liable for any indirect, incidental, or consequential damages, or any loss of data, arising out of or in connection with your use of (or inability to use) the Site or the Game. Nothing in these terms limits any liability that cannot be limited under applicable law.
Acceptable use
You're welcome to play and share the Game. Please don't:
- attempt to disrupt, attack, overload, or gain unauthorised access to the Site;
- use automated tools (bots, scrapers) to interfere with normal play;
- reproduce or rehost the Site or its content as your own; or
- use the Site for anything unlawful.
Intellectual property
The Site's design, code, written articles, and original artwork are the property of the Site operator and may not be copied or reused without permission, except where a licence is explicitly granted. The fonts are used under the SIL Open Font License. The game of Notakto, and its name, are not claimed as proprietary: the game was devised by Bob Koca, and the name comes from Thane Plambeck and Greg Whitehead's iPad app; the educational and historical content describing it draws on public sources, which are credited where relevant.
Your data
Notakto is deliberately lightweight. The Game does not require an account. Your chosen settings, your light or dark theme, and a count of your visits are stored locally in your own browser (via your browser's local storage); that information stays on your device. The Site uses Vercel Web Analytics, which is cookieless, to count page views and games started and finished in aggregate (for example the number of boards, the level, and whether a visit is a first or a return one). No account, name, email address, or other personal identifier is collected. If this ever changes, this page and a separate privacy notice will be updated to reflect it.

Changes to these terms
These terms may be updated from time to time. Any changes take effect once posted on this page, and the "last updated" date above will reflect the most recent revision. Continuing to use the Site after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Any disputes will be subject to the courts of that jurisdiction.
